Terms and Conditions

§ 1 Scope

(1) These Terms and Conditions apply to all contracts between

(hereinafter “Seller”)

and the customer (hereinafter “Buyer”) for the sale of goods via the website bcmeter.org, by email, or through the inquiry form.

(2) Deviating terms of the Buyer shall not be accepted unless expressly agreed to in writing by the Seller.

(3) These terms apply to both consumers and businesses. A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession (§ 13 BGB, German Civil Code).

§ 2 Conclusion of Contract

(1) The presentation of products on the website does not constitute a legally binding offer but an invitation to submit an offer (invitatio ad offerendum).

(2) Orders may be placed through:

  • The inquiry form on the website
  • Email to jd@bcmeter.org
  • The online shop (where available)

(3) For orders placed via the inquiry form or email, the contract is concluded upon the Seller issuing an order confirmation. For orders placed through the online shop, the contract is concluded upon receipt of the order confirmation email.

(4) The Seller reserves the right to decline orders without stating reasons.

§ 3 Prices and Payment

(1) All prices are final prices and include the applicable statutory value-added tax (VAT). Shipping costs are shown separately and are borne by the Buyer.

(2) The following payment methods are available:

  • Bank transfer (advance payment)
  • PayPal
  • Credit card

(3) When paying by bank transfer, payment is due within 7 days of the conclusion of the contract. Delivery will be made after receipt of payment.

(4) For deliveries to EU member states outside of Germany, a tax-exempt intra-Community supply may be made upon provision of a valid VAT identification number.

§ 4 Delivery and Shipping

(1) Standard shipping is available to the following countries and territories where the CE marking is recognized:

  • European Union: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden
  • EEA: Iceland, Liechtenstein, Norway
  • Other: Switzerland, Turkey

(2) Delivery to third countries without CE recognition (e.g. USA, Canada, United Kingdom): Delivery to countries requiring different certifications (e.g. FCC, ISED, UKCA) is available upon request. In such cases, the device is provided as a Research & Evaluation Kit. The Buyer assumes full responsibility for compliance with all regulatory requirements applicable in the destination country, including the procurement of any required authorizations (e.g. FCC Experimental License, ISED Technical Acceptance Certificate). The Seller assumes no liability for regulatory violations in the destination country.

(3) Shipping costs depend on the destination country, weight, and dimensions of the shipment and will be communicated to the Buyer before the conclusion of the contract.

(4) The standard delivery time is 5–15 business days after receipt of payment (for advance payment) or after the conclusion of the contract (for immediate payment methods). Deviating delivery times will be stated in the offer or order confirmation.

(5) The risk of accidental loss or deterioration of the goods passes to consumers upon delivery. For businesses, the risk passes upon handover to the carrier.

§ 5 Right of Withdrawal

Consumers have a 14-day right of withdrawal. The full withdrawal policy and model withdrawal form are available at Widerrufsrecht.

§ 6 Warranty

(1) Statutory warranty rights apply.

(2) The warranty period for new goods is two years from delivery to the Buyer (§ 438 (1) No. 3 BGB). For businesses, the warranty period is one year.

(3) Obvious defects must be reported in writing within two weeks of receipt of the goods. Timely dispatch of the notice is sufficient to meet the deadline.

§ 7 Liability

(1) The Seller is fully liable for damages resulting from injury to life, body, or health, as well as for damages caused intentionally or through gross negligence.

(2) In cases of slight negligence involving the breach of material contractual obligations (cardinal obligations), liability is limited to the foreseeable, contract-typical damage.

(3) Liability for slight negligence is otherwise excluded.

(4) The above limitations of liability do not apply in cases of mandatory statutory liability, in particular under the German Product Liability Act (Produkthaftungsgesetz).

§ 8 Retention of Title

The delivered goods remain the property of the Seller until full payment has been received.

§ 10 Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/

(2) The Seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of the state in which the consumer has their habitual residence shall remain unaffected.

(2) The place of jurisdiction for all disputes arising from the contractual relationship with businesses is Berlin.

(3) Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected.
